Legal Disclaimer
This Disclaimer records the limits of what the material published on pcf.org.pk is, and what it is not. It is not an attempt to disclaim responsibility for what the Foundation does with the money entrusted to it — that responsibility is accepted and is governed by the Terms and Conditions. It is a statement about the character of published information: what is advice and what is not, which figures are audited and which are indicative, which photographs depict real beneficiaries and which are representative.
1. Status of this Disclaimer
- 1.1This Disclaimer applies to every page, document, image, recording, statistic, appeal, report and communication published by Perfect Care Foundation (the “Foundation”) on or through the Platform, and to material published by the Foundation on any social-media channel it operates.
- 1.2It forms part of the Terms and Conditions, and capitalised expressions not defined here bear the meanings given there.
- 1.3Nothing in this Disclaimer excludes or restricts liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot lawfully be excluded or restricted.
2. No professional advice
- 2.1The content of the Platform is published for general information and for the purpose of charitable solicitation. It does not constitute, and must not be relied upon as, financial, investment, taxation, accounting, legal, medical, nutritional, psychological, educational or religious advice.
- 2.2No relationship of adviser and client, physician and patient, or mufti and questioner arises between the Foundation and any User by reason of the publication or reading of any content.
- 2.3Before acting or refraining from acting on anything published on the Platform, you should obtain advice from a qualified professional addressed to your own circumstances. The Foundation accepts no liability for any act or omission founded upon the content of the Platform.
3. Accuracy and currency of content
- 3.1Content is prepared in good faith and with reasonable care on the basis of information available at the time of publication. The Foundation does not warrant that it is complete, accurate, current or free from error.
- 3.2Content is liable to become out of date. A date appearing on a page indicates when it was published or last revised, and the absence of a date is not a representation that the content is current.
- 3.3The Foundation reserves the right to correct, amend, supplement or withdraw any content at any time without notice, and is under no obligation to notify any person of a correction.
- 3.4Where the Foundation becomes aware that published content is materially inaccurate, it corrects it promptly and, where the inaccuracy was capable of influencing a decision to contribute, publishes a note of the correction.
4. Impact figures and statistics
- 4.1Figures describing beneficiaries reached, meals served, patients treated, students enrolled, unit costs and comparable measures are operational estimates compiled from field reporting. Unless a figure is expressly stated to be drawn from audited financial statements, it is not an audited figure.
- 4.2Field data in the environments in which the Foundation operates is subject to duplication, estimation and revision. Figures are periodically restated as better information becomes available, and a restatement is not an admission that an earlier figure was published dishonestly.
- 4.3A unit cost — for example the stated cost of a ration parcel or of a month of a child’s schooling — is an average prevailing at the time of publication. It is not a price, not a quotation, and not a representation that a given Contribution will procure that unit, prices being subject to the volatility described in Clause 14.2 of the Shipping and Delivery Policy.
- 4.4Fundraising targets, progress bars and totals displayed against an appeal are indicative and may include pledged, restricted or in-kind amounts. They are not a statement of funds held.
- 4.5The Foundation’s audited financial statements, where published, are the authoritative statement of its financial position, and prevail over any figure appearing elsewhere on the Platform.
5. Forward-looking statements
- 5.1Statements concerning intended Programmes, planned expansion, anticipated beneficiary numbers, projected timelines and future facilities are statements of present intention, not undertakings.
- 5.2Such statements are subject to funding, access, security, regulatory approval, supplier availability and the exercise of the governing body’s discretion, and may not be realised.
- 5.3The non-realisation of a forward-looking statement is not a misrepresentation and is not a ground for the reversal of a Contribution, as Clause 5.4 of the Refund and Return Policy records.
6. Testimonials and beneficiary accounts
- 6.1Testimonials, case studies and beneficiary narratives describe the experience of the individual concerned. They are not representative of every beneficiary and are not a prediction of any outcome.
- 6.2Names and identifying particulars in published narratives are frequently changed, and details are frequently generalised, in order to protect the dignity and safety of the person described, in accordance with Clause 16 of the Privacy Policy. Where this has been done, the substance of the account remains true.
- 6.3A narrative is published only with the consent of its subject, or of a parent or guardian in the case of a child.
7. Photographs and representative imagery
Charitable fundraising has an unhappy history of passing off stock photography as documentary evidence of work actually done. The Foundation states its position explicitly rather than leaving it to inference.
- 7.1Photographs and recordings published on the Platform fall into two categories: documentary imagery, depicting actual staff, facilities, beneficiaries or distributions of the Foundation; and representative imagery, being illustrative photographs which do not depict a person connected with the Foundation.
- 7.2Representative imagery is used only to illustrate a general theme, and never in a manner intended or likely to convey that the person depicted is a beneficiary, a member of staff or a volunteer of the Foundation.
- 7.3Images of individuals identified by name as trustees, officers, staff or volunteers are documentary and depict those persons.
- 7.4Images of ration parcels, relief items, facilities and equipment illustrate the type of item concerned and are not a specification of the contents of any particular consignment, as Clause 14.4 of the Shipping and Delivery Policy records.
- 7.5Any person who believes an image has been used in a manner inconsistent with this Clause, or who is depicted in an image and wishes it withdrawn, may write to info@pcf.org.pk, and the Foundation will act in accordance with Clause 16.3 of the Privacy Policy.
8. Taxation of donations
- 8.1The taxation treatment of a donation depends upon the donor’s own residence, status, income and filing position, and upon the approvals held by the recipient organisation from time to time. It is a matter between the donor and the revenue authority.
- 8.2The Foundation does not advise upon, and does not warrant, the availability, amount or continuation of any tax credit, deduction, allowance or exemption under the Income Tax Ordinance, 2001 or any other fiscal statute, whether in Pakistan or in any other jurisdiction.
- 8.3A receipt or acknowledgement issued by the Foundation records the fact and amount of a Contribution. It is not a representation that the Contribution attracts any particular fiscal treatment, and it is not a certificate of entitlement to relief.
- 8.4Where the Foundation holds an approval or certification relevant to the fiscal treatment of donations, it will state so expressly and identify the approval. In the absence of such an express statement, no approval should be assumed.
- 8.5Donors should obtain their own advice from a qualified tax practitioner before making a Contribution in reliance upon an anticipated fiscal benefit. The unavailability of such a benefit is not a ground for reversal, as Clause 5.5 of the Refund and Return Policy records.
9. Shariah and religious matters
- 9.1Material published by the Foundation concerning Zakat, Sadaqah, Fitrana, Fidya, Kaffarah, Qurbani, Aqiqa and comparable observances is offered as general information reflecting the juristic opinions adopted by the Foundation and its advisers. It is not a fatwa and is not addressed to the circumstances of any individual.
- 9.2Reasonable scholars differ upon questions of eligibility, calculation, timing and permissible application. A person in doubt should consult a scholar whose authority they accept.
- 9.3A Zakat calculator or comparable tool published on the Platform produces an indicative figure from the inputs supplied. It does not account for every asset class or circumstance, and reliance upon it is at the user’s own responsibility.
- 9.4The Foundation gives no assurance as to the discharge of any individual’s religious obligation, as Clause 6.3 of the Terms and Conditions records.
10. Medical and health content
- 10.1Material describing the Foundation’s clinical activities, health campaigns or public-health guidance is general information and is not a diagnosis, a prescription, or a substitute for consultation with a qualified medical practitioner.
- 10.2Nobody should delay seeking, or disregard, professional medical advice because of anything published on the Platform. In an emergency, contact a hospital or emergency service directly.
- 10.3The availability of any clinical service at a Foundation facility is subject to capacity, staffing and eligibility, and its description on the Platform is not an undertaking to treat any individual.
11. External links and third-party content
- 11.1Links to external resources are provided for convenience. The Foundation does not control, monitor, verify or endorse their content, and excludes all liability arising from it.
- 11.2The inclusion of a link does not imply an association, partnership or endorsement between the Foundation and the linked party.
- 11.3The Foundation is not responsible for content posted by third parties on its social-media channels, and the appearance of such content does not signify agreement with it. The Foundation may remove content that is unlawful, abusive or misleading.
12. Availability and technical matters
- 12.1The Platform is provided on an “as is” and “as available” basis, as Clause 14.1 of the Terms and Conditions provides. No undertaking is given as to uninterrupted or error-free operation.
- 12.2The Foundation may suspend the Platform for maintenance, upgrade or security purposes without notice.
- 12.3The Foundation does not warrant that the Platform or any communication from it is free from viruses or other harmful components, and each User is responsible for the protection of their own device.
- 12.4The Foundation is not liable for loss arising from the Platform’s unavailability, including the inability to make a Contribution at a particular moment.
13. Fraudulent solicitation in our name
Charitable brands are impersonated. The Foundation solicits funds only through pcf.org.pk and through the bank account published on it: United Bank Limited, account 374276591, IBAN PK57UNIL0109000374276591. We will never notify a change of banking details by unsolicited message, will never ask for your card number, CVV, one-time passcode or banking password, and will never ask you to transfer funds to a personal account. If in any doubt, telephone 021-36924455 before paying anything.
- 13.1The Foundation accepts no liability for any sum paid to a person falsely purporting to act on its behalf, or to an account other than the account particulars published on the Platform.
- 13.2No person is authorised to solicit funds in the Foundation’s name without its prior written authorisation, and Clause 9.6 of the Terms and Conditions prohibits doing so.
- 13.3Suspected impersonation should be reported to info@pcf.org.pk and to the Federal Investigation Agency’s Cybercrime Wing.
14. Jurisdiction and solicitation
- 14.1The Platform is directed at persons in Pakistan. Its content is prepared by reference to Pakistani law and practice and may be inaccurate, inapplicable or unlawful elsewhere.
- 14.2Nothing on the Platform constitutes a solicitation in any jurisdiction in which the Foundation is not authorised to solicit, as Clause 3.4 of the Terms and Conditions records.
- 14.3A person accessing the Platform from outside Pakistan is responsible for compliance with the law applicable to them.
15. Trade marks and attribution
- 15.1Third-party names, marks and logos appearing on the Platform are the property of their respective owners and are used for identification only. Their appearance does not imply endorsement by or affiliation with their owners.
- 15.2The Foundation’s own marks are protected as described in Clause 11 of the Terms and Conditions.
16. Translations
- 16.1Where content is published in Urdu or another language, or is rendered by an automated translation facility, the English text is the authoritative version and prevails in the event of any inconsistency.
- 16.2The Foundation is not responsible for the accuracy of a translation produced by a third-party or automated service.
17. Limitation of liability
- 17.1To the fullest extent permitted by Applicable Law, the Foundation excludes liability for any loss arising from reliance upon content published on the Platform.
- 17.2Clause 15 of the Terms and Conditions applies in full to any claim founded upon this Disclaimer or upon published content, including the aggregate cap and the notification period there stated.
- 17.3Clause 1.3 of this Disclaimer applies to this Clause.
18. Reporting an inaccuracy
- 18.1The Foundation would rather be told it is wrong than continue to publish an error. Any person who considers that published content is inaccurate, misleading, out of date or improperly attributed is invited to write to info@pcf.org.pk identifying the page and the concern.
- 18.2The Foundation will investigate and respond within thirty (30) Business Days, and will correct any inaccuracy it identifies.
19. Governing law
- 19.1This Disclaimer is governed by the laws of the Islamic Republic of Pakistan and is subject to Clause 22 of the Terms and Conditions.
- 19.2It may be amended in the manner provided by Clause 19 of those Terms.
